Acceptance of Terms

By downloading or using FirstSet, you agree to these Terms & Fitness Disclaimer and Apple’s applicable App Store terms. If you do not agree, do not use FirstSet.

FirstSet uses Apple’s Standard End User License Agreement. This page supplements that agreement with app-specific fitness information.

General Fitness Education

FirstSet provides general fitness education, workout organization, exercise guidance, and progress tracking. Content is informational and is not a personalized training program.

Not Medical Advice

FirstSet is not a medical service and does not diagnose, treat, prevent, or cure any condition. Consult a qualified healthcare or fitness professional before beginning or changing an exercise program, especially if you have an injury, medical condition, or concern about whether exercise is appropriate for you.

Assumption of Risk

Physical exercise involves inherent risks, including strain, falls, and injury. You choose whether and how to perform an exercise and accept responsibility for using equipment, selecting weights, and training within your abilities.

Stop if You Feel Pain

Start light, use controlled form, and stop exercising if you feel sharp pain, dizziness, faintness, or unusual discomfort. Seek appropriate professional or emergency help when needed.

No Guarantee of Results

Training results vary. FirstSet does not guarantee strength gains, weight changes, health outcomes, or any particular result.

User Responsibility

You are responsible for checking your surroundings and equipment, choosing appropriate exercises and resistance, maintaining proper form, and deciding when to rest or seek qualified guidance. Weight suggestions are conservative estimates based on information recorded in FirstSet and are not instructions to exceed your capabilities.

Apple Health Information

Calorie information shown from Apple Health may be incomplete, delayed, estimated, or unavailable. Do not rely on it for medical decisions. Your use of Apple Health is also governed by Apple’s terms and policies.

Exercise Videos and Third-Party Links

FirstSet may link to exercise videos or other content provided by YouTube and third parties. Cold Harbor Studio does not control or endorse every statement in external content and is not responsible for its availability, accuracy, or privacy practices.

App Availability

FirstSet may change over time and may occasionally be unavailable because of device, network, iCloud, Apple Health, or platform conditions. Features may require a compatible device and current operating system.

Intellectual Property

FirstSet, its original interface, text, branding, and app content are owned by Cold Harbor Studio LLC or used with permission and are protected by applicable intellectual property laws. Third-party names and content remain the property of their respective owners.

Limitation of Liability

To the extent permitted by applicable law, Cold Harbor Studio is not responsible for indirect, incidental, special, or consequential losses arising from use of or inability to use FirstSet. Nothing in these terms excludes rights or responsibilities that cannot lawfully be excluded.

Changes to These Terms

We may update these terms as FirstSet changes. The revised version will be posted here with an updated effective date.
